NOTICE OF ADOPTION OF GLASGOW CITY PLAN 2

 

On 7th December 2009, Glasgow City Council by resolution, adopted the above-named local plan.

 

A certified copy of the plan and the resolution, together with a certified copy of the Report of Modifications (which includes the Reporters’ report on each objection considered at the inquiry and the Council’s decision on each objection and reasons for its decision), has been deposited at the following location where they may be inspected during normal office hours free of charge.

The Plan and report can be viewed on the city plan website www.glasgow.gov.uk/en/Business/CityPlan/  Computers are available to the public in the Mitchell Library and all branch libraries.

 

The Plan became operative on 7th December 2009, but if any person aggrieved by the plan desires to question its validity on the ground that it is not within the powers conferred by the Town and Country Planning (Scotland) Act 1997, or that any requirement or any regulations made thereunder has not been complied with in relation to the adoption of the plan, he or she may, within six weeks from 11th December 2009, make an application to the Court of Session under the provisions of the 1997 Act.

 

Also available to view is a copy of the Strategic Environmental Assessment (SEA) post adoption statement which indicates how the assessment was taken into account in the final plan document.

RESOLUTION OF CITY PLAN 2

 

Proposed modifications and adoption of plan approved – Instruction to Executive Director of Development and Regeneration Services.

 

With reference to the minutes of 22nd February 2008 (Print 6, page 804) approving the Finalised Draft City Plan 2 and noting the next stages in the Plan preparation, Councillor Ryan, Executive Member for Business and the Economy, presented a report regarding the proposed modifications and procedures for the adoption of City Plan 2, advising

 

(1)    that following a public local inquiry, the Reporter’s recommendations on the Council’s City Plan 2 had been received and that the Council were obliged under the terms of planning regulations to set out its response to each of the Reporter’s recommendations and give reasons for accepting or rejecting each recommendation;

 

(2)    that the Reporter’s recommendations fell into 4 categories, with the first 3 categories accounting for 92% of the Reporters’ recommendations, which meant that there had been strong endorsement of the Council’s proposed strategy and policy framework, and the other category accounted specifically for proposed modifications to the plan by the Reporter;

 

(3)    that it was proposed that the Council supported 832 (99.5%), part supported 3 (0.4%) and did not support 1 (0.1%) of the Reporter’s recommendations; and

 

(4) of the next stages leading to the adoption of City Plan 2.

 

After consideration, the committee

 

(a)    approved

(i)                  the Report of Modifications, including the proposed modifications to City Plan 2; and

(ii)                the adoption of City Plan 2 at the earliest opportunity, subject to there being no issues arising from the public consultation on the proposed modifications to the Plan which would necessitate reporting back to committee;

 

(b)    noted that

(i)                  the proposed modifications required to be advertised for a period of 6 weeks to enable representations to be made on them; and

(ii)                the final Plan had to be sent to the Scottish Ministers who had 28 days in which to direct the Council to proceed to adopt the Plan or carry out further work; and

 

(c)     instructed the Executive Director of Development and Regeneration Services to pursue the actions outlined in paragraphs 8.1 to 8.6 of the report with a view to securing Plan adoption.
