Background Information

 

 

The role of Enforcement

 

The Enforcement Unit is a civilian law enforcement unit operating under the umbrella of Glasgow City Council. The Unit is not affiliated to any Taxi or Private Hire Associations.

 

The powers available to the Enforcement Unit in complaints investigation are restricted to addressing incidents where a licence holder has contravened a condition or conditions attached to their licence, or where a licence holder fails to meet the requirements of the legislation that governs his/her licence.

 

 

Licence Holders

 

It is a common misconception that Glasgow City Council employs licensees. This is not the case. Taxi and Private Hire licences allow holders to run what is considered to be their own businesses.

 

As individual business owners, licensees are in a position to run their businesses as they see fit, with the proviso that they meet the requirements of the licences held and the law governing the licence.

 

 

 

Complaint Investigation

 

Allegations Raised

The Unit’s involvement in the allegations raised will be limited to pertinent points contained in your complaint, relative to our remit as detailed above.

 

The investigation will be pursued based upon the driver’s fitness to hold a licence.

 

 

 

Investigation Process

 

 

Each step of any complaint investigation must be documented due to the fact that there is potential for the complaint to progress to being heard in court.

 

The process to be followed for complaint investigation consists of:

 

Vehicle identification Identification of Licensed Operator Letter of Disclosure issued to Licensed Operator requesting driver details Driver interview letter dispatched to driver Driver interview Investigation concluded and assessed Response to complaint dispatched to complainant.

 

 

It is our intention to conclude the investigation within 4 to 6 weeks from the date of receipt of this acknowledgement, though the length of time taken to conclude the investigation is largely dependant upon the licensed operator’s and driver’s response time to our correspondence.

 

You will be provided with a response, as selected on the online form, detailing conclusions reached resulting from our investigation.
