Health and Safety

Together with the Health and Safety Executive (HSE), the Health and Safety Unit of Land and Environmental Services has responsibility for enforcing health and safety law in places of work.

 

As a general rule the Council has jurisdiction for the service industries and places such as offices, shops, restaurants, pubs and warehouses.  The HSE look after the larger manufacturing industries, mines, farms, railway safety and offshore gas and oil installations.

Health and Safety Advice

 

The Health and Safety Unit offers free advice on all health and safety matters to employers. employees and the general public.

Licensing Standards Officers

 

 

Who Are We

 

 

Licensing Standards Officers have been appointed by the Council in terms of the Licensing (Scotland) Act 2005 and are responsible for the provision of guidance and mediation to the licensed trade and the general public and to ensure compliance in terms of the legislation.

 

Our Aim 

  

The aim of Licensing Standards Unit is to protect the public by taking appropriate action to ensure Licence holders meet the requirements of their licence and the Act of Parliament that governs the licence.

 

This is achieved by meeting the following objectives:

 

Ø        Protecting the rights of the people who drink responsibly.

Ø       Being pro-active to protect communities from nuisance caused by the mismanagement or irresponsible operation of licensed premises.

Ø       Thorough investigation of complaints raised against licensees who through their mismanagement and/or irresponsible actions cause nuisance to communities.

Ø       Providing a meaningful mediation service between licence holders and third parties in relation to issues surrounding the Licence.

Ø       Providing guidance to Licence Holders and prospective Licence Holders to enable them to comply with the Licensing Board’s Policies

Ø       Taking effective remedial action in the event of non compliance

Ø      Taking formal action in the event of continued non compliance.

 

 

What should you expect from the Licensing Standards Officers 

 

·         A sound understanding of the business of the licensed trade

·         Proper concern for the rights of neighbours

·          Proper knowledge of the rights and duties of the licensee

·         A recognition of when to advise customers that legal or other advice should be sought

·          An understanding of licensing policy as it relates to health

·          Impartiality.

·         Assistance to help parties to resolve disputes by dialogue where appropriate

·         A balanced perspective on the interests of the public, the licensed trade and the community

 

 

  

 

The Role of Licensing Standards

 

 

Our remit covers:- 

  

 

Guidance 

 

The Licensing Standards Officers have a wide-ranging remit to offer guidance and advice to licence holders and communities in relation to the existing legislation, namely the Licensing (Scotland) Act 1976 and the new legislation namely the Licensing (Scotland) 2005. The Officers will also offer guidance and assistance to licence holders on any new policies and procedures of the Licensing Board and how they relate to the operation of licenses

 

Mediation

 

The Licensing Standards Officers will act as intermediaries between licence holders and the general public to help resolve any disputes or disagreements that may arise. They will remain impartial, treat everyone equally and make their services available to both members of the public and licence holders. They will also provide mediation services at licensed premises, and in certain circumstances, private residences or at a location agreed by all parties.

 

Compliance

 

The Role of the Licensing Standards Officers also relates to enforcement and compliance of the legislation. The Officer will therefore ensure compliance by the holders of premises and occasional licences in respect of their premises and other requirements of the Act. This is achieved through various measures such as routine, scheduled and policy targeted visits, investigations, processing of complaints, issuing notices, taking informal and formal action and initiating reviews of licences for possible suspension where persistent non-compliance is identified.

 

Complaints

 

Licensing Standards Officers investigate complaints made in relation to the operation and management of licensed premises. Complaints can therefore be made in a variety of ways namely by E-Mail or by letter. All complaints will be acknowledged in writing, investigated thoroughly within a specified timescale, recorded for future reference and dealt with in a courteous, confidential and professional manner. All complainants will also be informed of the outcome of the complaint and any action taken. 

 

 

Investigations

 

Licensing Standards Officers carry out inspections of licensed premises on a routine, scheduled and policy targeted basis. This is to ensure compliance, to assist in the processing of complaints, to assist in the formulation of Board policies, to provide licence holders with assistance and guidance relative to the legislation and Board policies and to allow licence holders a forum to raise any concerns or problems they may have.

 

 

Inspections

 

Licensing Standards Officers have powers of entry to all licensed premises and may when visiting premises inspect any substances, articles or documents in order to assist in an inspection or investigation. It should also be noted that it is the duty of the licence holder, premises manager or any person working on the premises to assist that Officer, that this applies at any time and not just during the licensing hours and that the obstructing a Licensing Standards Officer or failing to comply with a requirement of the Officer is an offence.

 

Drop In Surgeries

 

 Licensing Standards Officers conduct surgeries at various locations on a regular basis to ensure that they understand the needs and aspirations of both the licensed trade and the public in relation to the management and operation of licensed premises. At these surgeries both the licensed trade and members of the public are free to attend to receive information and guidance, to raise any areas of concerns they may have and to speak to the Licensing Standards Officers in confidence.  The aim of the surgeries is to ensure to that the licensed trade and the local communities have access to, and feel part of the licensing process.

 

Seminars

 

Licensing Standards Officers conduct seminars at various locations on a regular basis to provide information, assistance and awareness to licence holders and members of the public in relation to their rights and responsibilities in terms of the Licensing (Scotland) Act, 2005.   At these seminars both the licensed trade and members of the public are invited to attend and receive information and guidance from the Licensing Standards Officers and various invited guest speakers on the requirements of the legislation. The aim of the seminars is to raise awareness of the legislative provisions and to ensure to that the licensed trade and the local communities have access to and feel part of the licensing regime.

The Law on Smoking has changed - Does your business comply?

Background

 

The Scottish Parliament voted to ban smoking in all enclosed public places because of the health risks associated with passive smoking.

This new law came into effect on 26th March 2006 and applies to businesses, workplaces, clubs, pubs and restaurants.
