What is a ‘noise problem’?

 

 

A noise problem is one which could:

  • Prevent you being able to sleep at night.
  • Lead to significant loss of amenity due to noise or vibration, even during the day.
  • Lead to undue disturbance by others affecting your home or your place of work.  This could be from music, alarms, machinery, acts of unreasonable behaviour resulting in unacceptable amounts of noise being produced etc.
  • Be due to a deficiency in the sound insulation within the property.

 

What can you do if you feel you have a noise problem?

  • Consider approaching those responsible for the noise to make them aware of the problem.  They may not even realise they are disturbing you.
  • If this doesn't work or if you feel you cannot speak to the noise maker then please contact Land and Environmental Services as detailed above.

 

Land and Environmental  Services provide a comprehensive noise control service both during and outwith office hours.

 

  • Your complaint will deal with in compliance with all relevant charters produced by Land and Environmental  Services
  • We aim to visit or telephone you to discuss your complaint on the day the complaint is received.
  • We will keep you informed throughout all stages of our investigation
  • We will deal with all complaints in a polite and courteous manner and respect the sensitive nature of any complaint
  • We will aim to visit you at suitable times to witness the noise.  You will be offered a minimum of three visits to this end.
  • We will offer advice on possible actions and assess the noise complained of to decide what action can be taken.
  • Where appropriate we may approach the person complained of and attempt to find a solution.
  • We will use noise monitoring and/or recording equipment, where necessary
  • We will issue Warning Notices and Fixed Penalty Notices or use other enforcement powers as appropriate however we will notify you prior to taking any legal action that may require your attendance at court.
  • We will offer advice on alternative actions

What we need to know

 

  • Your name, address and telephone number
  • The nature of the noise causing you disturbance
  • The address of the noise source

Confidentiality

 

  • Details of your name and address will be kept in confidence
  • Occasionally, however, the person you have made a complaint about may guess who has complained or may approach you to ask if you made the complaint
  • In addition, if the Council decides, with your agreement, to take formal action, you may require to appear in Court as a witness.

What you can do to help our investigations?

 

  • Keep records of all conversations, letters, etc relevant to your noise complaint
  • Gather all relevant details of the noise problem.  Keep written record of dates and times of disturbances.
  • Let us know about any changes in circumstances.
  • Accept that sometimes we may be unable to resolve the problem informally and may, with your agreement, have to resort to a formal legal process.

 

Land and Environmental Services provide a comprehensive noise control service, including an out-of-hours unit available to deal with noise at night.
