Public Processions

Background
Following the Guidance issued by Scottish Ministers under section 65A of the Civic Government (Scotland) Act 1982, which set out the changes to the law of Public Processions made by the Police, Public Order and Criminal Justice (Scotland) Act 2006, the Council has now formulated a code of conduct, which both reflects local conditions and experiences and also takes account of the new statutory framework and the good practice set out in the Guidance.
Following a stakeholder consultation Glasgow City Council agreed a revised Code of Conduct for Public Processions on 9th December 2010.
Glasgow City Council recognises the fundamental rights contained in the European Convention on Human Rights in relation to freedom of assembly and of association. The Council, in administering notifications for public processions in the city, takes these rights into consideration along with the provision within Article 11 of the Convention which requires that these rights are exercised in accordance with the “protection of the rights and freedoms of others.”
The Council’s aim is to strike a reasonable balance between protecting the fundamental right of individuals and organisations to organise and participate in public processions, and the need to minimise disruption to the wider community by protecting the rights of all of Glasgow’s citizens to go about their business without unnecessary disturbance and interference.
The code of conduct recognises the need to achieve balance between the legitimate desire of people to protest, to celebrate their history and cultural traditions, or to raise awareness of issues that they regard as important, and the legitimate right of non-participants to go about their daily lives with minimal disruption and inconvenience.
It is critical to its success that the Council work with the Police and procession organisers to ensure that the code of conduct is applied equally to the broad range of organisations that might wish to hold events in the city, is implemented fairly, adhered to on a consistent basis and monitored properly.
The code of conduct is intended to be a general one which applies to those who organise processions, and those who wish to take part.
As part of the implementation of this code of conduct the Council intends to provide more information to members of the public on future public processions.
In addition, the Council will also keep an opt-in list to make sure that anyone who asks for details of processions to be held in their area can receive the appropriate information to allow them to plan better and work around any problems which could be caused by the procession. A Guide to Community Events
The Council has also produced a useful ‘how to’ guide entitled Glasgow’s Community Events Guide which drafts sets of codes to cover all the events that take place in the city. It has been developed as a reference tool for use in Glasgow by individuals and organisations planning small and medium sized community events.
