Assured Tenancies

 

Assured tenancies are not very common. However this is the default tenancy in Scotland if you have no written tenancy agreement with your landlord.

 

Not all properties can be let under an Assured Tenancy Agreement so it is important to get legal advice if you are unsure what tenancy you may have.


If you rent your accommodation from a private landlord it is possible you have an assured tenancy, especially if you fall into these categories:

  • your tenancy started after 2 January 1989
  • at the time of signing your tenancy contract you were not given an AT5 form which stated your tenancy was going to be a short assured tenancy
  • your accommodation is your main home
  • it is residential property that you rent
  • the landlord does not live with you in the property you rent.

Tenants with an Assured Tenancy have greater rights than tenants on short assured tenancies.
