The Accounts Section makes payment to Contractors, Architects and other professional bodies involved in the Council's ongoing Programme of Statutory Works to the City's Private Sector Housing stock.

Payments

 

The Accounts Section makes payment to Contractors, Architects and other professional bodies involved in the Council's ongoing Programme of Statutory Works to the City's Private Sector Housing stock.On completion of those works, the Council issues the owners/occupiers of the affected properties with an account for their share of the costs incurred.

 

Housing (Scotland) Act 1987 - Section 108 Accounts  

 

Following full implementation of the Housing (Scotland) Act 2006, the issue of new Section 108 accounts ceased on 31/03/2012. If you have received a Section 108 account which is dated prior to 31/03/2012 and have any questions about your account then you should contact:

Housing (Scotland) Act 2006 - Section 35, Section 36, Section 49 and Section 50 Accounts

 

The position with regard to eligibility for Grant has changed significantly since the introduction of the Housing (Scotland) Act 2006 on 01/04/2010. In the past, Grant was mandatory where the Council served a Stautory Notice, however, this is no longer the case and when a Notice is served  Grant will only now be considered where it is deemed necessary to meet the requirements of the Council's strategic objectives and priorities.

 

Also, it is important to note that the Council currently charges a fee for administrative and professional services and the cost of any outlays required as a result of our involvement in works that are necessary in terms of S35/S36/S49/S50 of the Houisng (Scotalnd) Act 2006.

Money Advice

 

If required, general money advice can be provided by Accounts Section staff, with a view to assisting owners/occupiers in deciding the best way to finance payment of their share of the cost of the works. If, however, any owner/occupier is experiencing wider difficulties because there are a number of other debts on top of the S35, S36, S49, S50 or S108 debt that is owed to the Council, then it may also be advisable to consider contacting a money advice centre. The staff there can advise on how to claim any benefit entitlements, as well as arranging agreements with creditors to repay the various debts at acceptable payment levels.

 

You may also contact GAIN (Glasgow Advice and Information Network) which is a network of agencies that give free, confidential and impartial debt advice. It includes voluntary agencies, citizens advice bureaux, legal, housing and independent money advice agencies.

  • National Debtline - which is a national telephone helpline for people with debt problems in Scotland, England and Wales. Recovery of Accounts

 

Accounts Section staff will pursue recovery of the sums being re-charged to the owners/occupiers, through to either the payment of the account or to the point where the debt has been secured by the Council.

 

The Section 108 legal process normally takes the form of Court Action in respect of commercial premises or the recording of a Charging Order against the Title in respect of domestic property.

 

The legal process in respect of S35, S36, S49 and S50 Accounts will normally take the form of Court Action in respect of commercial premises or the recording of a Repayment Charge against the Title in respect of domestic property.

 

 

 

Property Enquiries

 

Property Enquiry letters are frequently received from Solicitors or professional search companies. In each case a response is issued detailing any outstanding Statutory Notices and, where applicable, any debt which is due to the Council in this regard. Very often there will also be a requirement to provide Practical Completion Certificates or Guarantee Certificates for certain types of work carried out under Statutory Powers. The Accounts Section holds much of this documentation, before it is passed on where appropriate to the owners/occupiers or their Agents.

 

Home Loans 

 

Although Glasgow CIty Council is no longer involved in the direct provision of loans the Accounts Section has, since the the Stock Transfer process in 2003, managed all aspects of the remaining City Council Home Loan portfolio.
